一、李林霞诉重庆漫咖文化传播有限公司劳动合同纠纷案

【裁判要旨】
网络主播与合作公司签订艺人独家合作协议,通过合作公司包装推荐,自行在第三方直播平台上注册,从事网络直播活动,并按合作协议获取直播收入。因合作公司没有对网络主播实施具有人身隶属性的劳动管理行为,网络主播从事的直播活动并非合作公司的业务组成部分,其基于合作协议获得的直播收入亦不是劳动法意义上的具有经济从属性的劳动报酬。因此,二者不符合劳动关系的法律特征,网络主播基于劳动关系提出的各项诉讼请求,不应予以支持。

[Judgment Abstract]

The network anchor entered into an Entertainer Exclusive Cooperation Agreement with her cooperative company. The company designed her image and recommended a third-party Internet live broadcasting platform for her to register with and engage in Internet live broadcasting activities, from which she gained incomes according to the cooperation agreement. As no labor management with the nature of personal subordination was implemented on the anchor by the cooperative company, and the live broadcasting activities carried out by her was not part of the cooperative company's business, the incomes she gained from producing live broadcasting content according to the cooperative agreement was not the labor remunerations based on her economic subordination to the company as prescribed by the Labor Law. Therefore, the relation between both parties didn't conform to the legal characteristics of an employment relationship, and the claims filed by the network anchor based on an employment relationship should not be supported.

【裁判摘要】

用人单位应依据劳动合同法的规定,在解除或终止劳动合同时出具解除或终止劳动合同的证明,在十五日内为劳动者办理档案和社会保险关系转移手续,并在合理期限内为劳动者办理专业证件转移手续。用人单位不及时办理上述事项,致使劳动者在再次就业时无法办理相关入职手续,或者无法出示相关证件,严重影响新用人单位对劳动者工作态度和职业能力的判断,从而导致劳动者不能顺利就业,损害劳动者再就业权益的,应对劳动者的未就业损失进行赔偿。

[Judgment Abstract]
In accordance with the provisions of the Employment Contract Law, the employer should issue a certificate in the rescission or termination of an employment contract, undergo formalities for the transfer of personnel archives and social security relations within 15 days for the employee, and undergo the formalities for the transfer of professional certificates within a reasonable time limit for the employee. Where the employer fails to handle the aforesaid matters in a timely manner, giving rise to the employee's failure to undergo the relevant entry formalities or present the relevant certificates in the re-employment, seriously affecting the new employer's judgment of the employee's working attitude and vocational capability, resulting in the employee's failure in smooth employment, and damaging the employee's re-employment rights, the employer should compensate the employee for his loss of non-employment.

【裁判要旨】
工伤赔偿与第三人侵权赔偿是基于不同的法律关系而产生的两种不同的赔偿责任,二者不能相互代替。但是,鉴于受伤职工的损失不能因工伤与侵权竞合获得双份赔偿而获益,所以其医疗费只能获得一份赔偿。在司法实践中,侵权人已赔偿医疗费的,工伤保险基金可以其已获得赔偿为由主张免除此部分责任;侵权人未赔偿医疗费的,工伤保险基金应先予以赔偿,然后再就其向侵权人追偿。
[Judgment Abstract]
Compensation for work-related injury and compensation for a third party's infringement are two different liabilities based on different legal relationships, so they cannot be replaced by each other. However, given that an injured employee may not benefit from the double compensation as a result of the concurrence of work-related injury and tort, only one compensation for medical expenses can be obtained. In judicial practice, if an infringer compensates for medical expenses, the work-related injury insurance fund may claim exemption from this part of liability on the grounds that the injured has been compensated; and if the infringer does not compensate for medical expenses, the work-related injury insurance fund should first make compensation and claim reimbursement from the infringer.
